Limit for cash payments and receipts equal to or greater than 1.000 Euros

Today, There are still many people who do not know that there is a limit to make cash payments in Spain. ¿Sabias que si no lo cumples puedes ser sancionado por la Agencia Tributaria?

¿Cuál es el límite de los pagos en efectivo?

The law 11/2021 of the 9 July of prevention and fight against tax fraud measures, known as anti -arude law, limits cash payments from 1.000 euros. That is, cash payments can be made equal to or higher than 1.000 euros.

  • The limitation applies at least one of the parties involved in the operation being an entrepreneur or professional and not between two individuals.
  • You cannot fraction the amount of a sale higher or equal to 1.000 euros, I mean, cannot be paid for example 500 euros in cash and the rest by transfer.
  • Tickets are considered effective means, carrier currencies and checks.
  • All operations carried out equal to 1.000 euros or superiors must keep the supporting during 5 Years, In case the Tax Agency requires it.

Penalties of breach of the limitation of cash payments

It is important to highlight that breach of these regulations implies a serious administrative infraction, and both buyer and seller, They are responsible for said breach, So the tax sanction can indistinctly against any of them.

The sanction will be calculated in the amount paid in cash in that transaction, being the fine of a 25% of said amount.

It should also be noted that if one of the two parties denounces the operation to the Tax Agency in the following three months, facilitating the other intervening person data, will be exonerated from said responsibility and free of the sanction.
